Okay, so here is my position. I am a contractor in Atlanta and unlike most who decided to just bankrupt, I decided I would do my best to keep going as long as possible. Well, the bubble burst in 2006, and I have had almost no work since then and I am now beginning to run short on funds. i have paid all my subs and I owe no one money.
The problem is that Ironstone bank loaned me the money for specifically three lots to build homes, however before I could get started on them, the bubble burst and Ironstone refused to loan the money for the materials necessary to build the homes. For the record I am not the only builder this is happening to at the moment, however, I am one of the few still “Alive”. The problem is that although I’ve paid off everyone whom I owe money to, Ironstone will not take the lots back or allow me the funds to proceed with the building of the homes.
I have tried to work with them to make a deal in which I would build them the homes for no profit to myself and they take the interest, however, this was a resounding no. I have a family to take care of and they are now attempting to come for all of my personal money (Which is quickly depleting) in court. I have been in a similar situation, however, siding with Ironstone and was represented by an Ironstone lawyer.
When in the case, I discussed all my financial plans and how I would deal with the situation were it to happen to me with the lawyer. Now I have been informed that this same lawyer will be representing Ironstone bank against me. I feel this is a major conflict of interest and I do not know what to do. This lawyer knows all of my personal information and my hypothetical plan for this situation.
I am in dire need of legal advise here. Any help is greatly appreciated!
P.S. I’d like to at the very least say that through all this I have done my best to be the most honest, reliable, and hard-working man that I could be. I have not tried to steal any money from anyone or anything of the sort. I feel like I am being betrayed.
